| Introduction | The Word ‘surrogacy’ is derived from Latin word surrogates, which means substitute. Surrogacy is an arrangement in which a woman carries and delivers a child for another couple or person. She carries the pregnancy with an embryo, to which she has no genetic relationship, transferred to her uterus. Supreme Court of India in 2002 has recognised commercial surrogacy as legal; wherein a surrogate mother receives financial compensation for performing as a surrogate. India is emerging as a leading destination in international surrogacy and in surrogacy-related fertility tourism. In order to protect medical, social, legal and ethical rights of all those concerned and especially for the protection and well-being of surrogate mothers there is an immediate need for the legislation on Surrogacy. |
