Introduction Don Davidson advocates Section 12 (Seasonal Resort Community) of the Dennis Zoning Bylaw adopted at Town Meeting in November, 2010. At that time, the Town Planner said: "In November, Town Meeting will be asked to vote on zoning proposals designed to improve conditions for the Town’s summer population." After two years of refusing to enforce key elements of that bylaw, the Building Commissioner writes: "I cannot offer an opinion as to the 'intent' of the individual(s) who crafted the zoning by-law as it would be pure speculation. But I can attempt to answer your questions as the zoning enforcement officer. As you know, once a zoning by-law is adopted by TM its crafters are required to step aside and it becomes someone else’s responsibility to interpret and enforce. MGL 40A §7 identifies the building commissioner as the authority who will interpret and enforce zoning by-laws in Massachusetts." This blog is a review of how and why the Town of Dennis created the Seasonal Resort Community Zone, as well as how the Town's Administration has not required certain property owners to comply with the will of the voters of that November, 2010 Special Town Meeting.
