The courts would apply strict scrutiny to any challenge on the basis of color. Strict scrutiny requires the government to prove the program, if it discriminates on the basis of color, advances a compelling government interest and is narrowly tailored to achieve that interest/goal.

I cannot wait to hear the government's argument for why it is ok for the government to spring for one color of people's health insurance but everyone else is on their own. My guess is that there is a solution to the problem that is more narrow than buying one group's health insurance but not everyone else's.
