The sheriff _should_ have fired all 5 of the deputies; the photo should have been considered irrelevant to the issue. They should have been fired for drinking while in uniform and using the county's car for transportation.
The waitress was probably stone cold sober and therefore the only one in the group with any business holding the rifle.

Still, considering all the possible cop activities, at least this one doesn't seem to have left a trail of dead bodies.
